Off of the California ballot

Keyes Wins California Lawsuit on Procedural Issues
August 26th, 2008
On August 26, Superior Court Judge Michael Kenny ruled in favor of the Alan Keyes faction of the American Independent Party. The case is called King v Bowen, 34-2008-80000016. Judge Kenny said that the Chuck Baldwin faction of the party should have filed the lawsuit sooner. Also he said the Baldwin faction should have served Alan Keyes as an indispensible party. Therefore, the California ballot will list Alan Keyes as the presidential nominee of the American Independent Party, not Chuck Baldwin.

It is probably too late for the Chuck Baldwin faction of the party to appeal the ruling on which presidential candidate should be on the November ballot. However, the American Independent Party activists who brought the lawsuit are free to bring a new lawsuit, over who the legitimate party officers are. At the hearing, the Chuck Baldwin faction argued that its state convention on June 28 was legitimately called, and the Alan Keyes faction of the party did not seem to contest that point. The case was dismissed without prejudice, which means that the substantive issues have not yet been addressed. Here is the court website. Click on the link. This is certainly a HUGE disappointment. Without ballot status in CA, NY and TX it will be really tough for Chuck to generate much media now. This decision is a real shame.

Bummer.

I would ad that situations like this would not be a concern if members of the CP state parties took the time to recruit and build there respective state organizations between elections. That means donating money and time. If you have local candidates running in your state get out there and get them some support so that in 2 and 4 years from now your state can retain ballot access.

Strong state parties are going to be the key to the future. You would figure that I just stated the obvious, but if it was really that obvious more states would be doing it.

Okay, so what is the Baldwin Campaign people saying about this? Will there be an appeal attempted? Or will they try what some of us have advocated about Trying to win an electoral vote in Nebraska?-Which would DEFINITELY generate media attention.

This is farkin ridiculous.

We have the internet people. There is no reason between Alex Jones, Chuck Baldwin's media contacts, youtube and google TV that the Constitution Party still can't emerge in the fall.

Okay so Alan Keyes is on the American Independent Party, does California have a Constitution Party on the ballot ??

If not let the Constitution Party actually register and get on the Californian ballot.

Why do people needlessly make things difficult ??

No, there is no CP on the ballot in CA. AND it is too late to qualify for a CP ballot line for 2008. THAT is why this decision is such a disappointment.

That will depend on whether or not the state party affiliate files the appropriate paperwork with the Secretary of State. I do not know what the timeframe is for doing this but I would have to assume it will be done.
